“मिशन न्याय”

सार्वजनिक संस्थानों में न्याय, अधिकार एवं व्यवस्था सुधार की राष्ट्रीय पहल

“मिशन न्याय” विश्व मानवाधिकार अनुसंधान परिषद् (WHRRC) द्वारा स्थापित एक राष्ट्रीय सार्वजनिक हित परियोजना है। इसका उद्घाटन 26 अगस्त 2026 को परिषद् की चेयरपर्सन एवं सुप्रीम कोर्ट अधिवक्ता डॉ. ज्योति जोंग्लुजू द्वारा किया गया।


अध्याय 1

परिचय, पृष्ठभूमि एवं स्थापना

भारत में केंद्र सरकार, राज्य सरकार और स्थानीय शासन द्वारा नागरिकों को अनेक प्रकार की सार्वजनिक सेवाएँ एवं सुविधाएँ उपलब्ध कराई जाती हैं। इन सेवाओं के संचालन के लिए सार्वजनिक धन का उपयोग किया जाता है। इन संस्थाओं की कार्यप्रणाली संविधान, अधिनियमों, नियमों, शासन की गाइडलाइन, विभागीय निर्देशों, न्यायालयीन निर्णयों तथा निर्धारित सेवा मानकों से संचालित होती है। व्यवहार में कई बार कानून में निर्धारित व्यवस्था और धरातल पर उपलब्ध सेवाओं के बीच अंतर दिखाई दे सकता है। नागरिकों को अपने अधिकारों की पर्याप्त जानकारी न होने के कारण वे उपलब्ध सेवाओं और वैधानिक उपायों का प्रभावी उपयोग नहीं कर पाते। इसी आवश्यकता को ध्यान में रखते हुए “मिशन न्याय” की स्थापना की गई है। “मिशन न्याय” का उद्देश्य सार्वजनिक संस्थाओं के विरुद्ध अभियान चलाना नहीं है। इसका उद्देश्य कानून और वास्तविक स्थिति के बीच अंतर का अध्ययन करना, नागरिकों को उनके अधिकारों के प्रति जागरूक करना, कमियों को तथ्य एवं प्रमाण के आधार पर दर्ज करना और सुधार के लिए सक्षम प्राधिकरण के समक्ष व्यवस्थित रिपोर्ट प्रस्तुत करना है। यह प्रोजेक्ट सार्वजनिक संस्थाओं और प्रशासन को प्रतिद्वंद्वी के रूप में नहीं देखती, बल्कि नागरिकों को बेहतर सेवाएँ उपलब्ध कराने वाली व्यवस्था के निर्माण में सहयोगी भूमिका निभाने का प्रयास करती है।

“मिशन न्याय” का मूल दृष्टिकोण

ऐसी सार्वजनिक व्यवस्था के निर्माण में योगदान देना जिसमें प्रत्येक नागरिक को कानून के अनुरूप समान, सम्मानजनक, सुलभ, सुरक्षित और गुणवत्तापूर्ण सार्वजनिक सेवाएँ प्राप्त हों तथा सार्वजनिक संस्थाएँ पारदर्शिता और जवाबदेही के साथ कार्य करें।

मूल संकल्प

“अधिकार की जानकारी, कानून का अध्ययन, व्यवस्था का निरीक्षण और सुधार के लिए प्रमाण-आधारित प्रयास।”


अध्याय 2

दृष्टिकोण, मिशन, उद्देश्य एवं मूल सिद्धांत

“मिशन न्याय” का व्यापक दृष्टिकोण एक ऐसी व्यवस्था के निर्माण में योगदान देना है जिसमें नागरिक अपने अधिकारों से परिचित हों और सार्वजनिक संस्थाएँ अपने वैधानिक एवं प्रशासनिक दायित्वों का प्रभावी रूप से पालन करें। इस प्रोजेक्ट का मिशन सार्वजनिक संस्थानों की सेवाओं एवं व्यवस्थाओं का व्यवस्थित अध्ययन करना, नागरिकों को उनके अधिकारों के प्रति जागरूक करना, कानून एवं निर्धारित मानकों के अनुपालन का मूल्यांकन करना, कमियों को प्रमाण सहित दर्ज करना तथा सुधारात्मक सुझावों के साथ सक्षम प्राधिकरण को रिपोर्ट प्रस्तुत करना है।

प्रमुख उद्देश्य

“मिशन न्याय” के अंतर्गत नागरिक अधिकार जागरूकता, सार्वजनिक सेवा मूल्यांकन, कानून एवं नियमों के अनुपालन का अध्ययन, शासन की गाइडलाइन का परीक्षण, न्यायालयीन निर्णयों का संदर्भ, आवश्यक अंतरराष्ट्रीय मानकों का अध्ययन, तथ्य एवं प्रमाण का संकलन, संस्थागत जवाबदेही, सुधारात्मक अनुशंसा और Follow-up को प्रमुख उद्देश्य बनाया जाएगा। इस प्रोजेक्ट का एक महत्वपूर्ण उद्देश्य केवल किसी एक संस्था की समस्या का अध्ययन करना नहीं, बल्कि यदि एक जैसी समस्या अनेक संस्थाओं में दिखाई देती है तो उसे व्यवस्थागत समस्या के रूप में पहचानना और व्यापक सुधार के लिए अध्ययन करना भी होगा।

मूल सिद्धांत

“मिशन न्याय” न्याय, मानव गरिमा, समानता, गैर-भेदभाव, पारदर्शिता, जवाबदेही, निष्पक्षता, सत्यनिष्ठा, कानून के सम्मान, नागरिक हित, प्रमाण-आधारित कार्यप्रणाली, गोपनीयता और व्यवस्था सुधार के सिद्धांतों पर आधारित होगा।


अध्याय 3

कार्य क्षेत्र एवं सार्वजनिक संस्थागत व्यवस्था

“मिशन न्याय” का कार्यक्षेत्र केवल उन सार्वजनिक संस्थानों, कार्यालयों, विभागों एवं सार्वजनिक उपक्रमों तक सीमित रहेगा जिन्हें केंद्र सरकार, राज्य सरकार अथवा स्थानीय शासन से सार्वजनिक धन अथवा बजटीय आवंटन प्राप्त होता है। इनमें आवश्यकता एवं प्रोजेक्ट की प्राथमिकताओं के अनुसार सरकारी अस्पताल, विद्यालय, महाविद्यालय, विश्वविद्यालय, सार्वजनिक स्वास्थ्य संस्थाएँ, पुलिस संस्थान, जेल, नगर निकाय, पंचायतें, सार्वजनिक वितरण प्रणाली, सामाजिक कल्याण संस्थाएँ, सार्वजनिक परिवहन, सरकारी कार्यालय और अन्य सार्वजनिक रूप से वित्तपोषित संस्थाएँ शामिल हो सकती हैं। किसी संस्था का चयन उसके सार्वजनिक महत्व, नागरिकों पर प्रभाव, सेवा की प्रकृति, उपलब्ध सूचना, संभावित व्यवस्थागत समस्या और जनहित को ध्यान में रखकर किया जाएगा। “मिशन न्याय” किसी भी संस्था का निरीक्षण केवल व्यक्तिगत आरोप या अपुष्ट शिकायत के आधार पर नहीं करेगा। जहाँ शिकायत किसी व्यापक संस्थागत समस्या की ओर संकेत करती हो, वहाँ प्रारंभिक अध्ययन के बाद संस्थागत निरीक्षण पर विचार किया जा सकता है।


अध्याय 4

कानूनी एवं मानक आधारित पूर्व-अध्ययन

“मिशन न्याय” की निरीक्षण प्रक्रिया की सबसे महत्वपूर्ण विशेषता यह होगी कि निरीक्षण से पहले संस्था का विस्तृत कानूनी अध्ययन अनिवार्य होगा। किसी सार्वजनिक संस्था के निरीक्षण अथवा निरीक्षण की अनुमति के लिए आवेदन प्रस्तुत करने से पहले संबंधित संस्था पर लागू अधिनियम, कानून, नियमावली, विनियम, शासन की गाइडलाइन, शासनादेश, विभागीय दिशा-निर्देश, नागरिक चार्टर, सेवा मानक और अन्य सरकारी दस्तावेजों का अध्ययन किया जाएगा। इसके अतिरिक्त संबंधित विषय पर महत्वपूर्ण एवं प्रासंगिक न्यायालयीन निर्णयों का अध्ययन किया जाएगा। जहाँ प्रासंगिक हो, संविधान के संबंधित प्रावधानों तथा अंतरराष्ट्रीय मानवाधिकार एवं सार्वजनिक सेवा मानकों का भी अध्ययन किया जाएगा। अंतरराष्ट्रीय मानकों का उपयोग करते समय यह स्पष्ट रखा जाएगा कि कौन-सा प्रावधान भारतीय कानून के अंतर्गत बाध्यकारी है और कौन-सा अंतरराष्ट्रीय मार्गदर्शक सिद्धांत अथवा सर्वोत्तम प्रथा है।

संस्था-विशिष्ट अध्ययन

“मिशन न्याय” में प्रत्येक संस्था के लिए अलग कानूनी अध्ययन किया जाएगा। अस्पताल के लिए लागू कानून और मानक अलग होंगे, जबकि विद्यालय, पुलिस संस्था, जेल, नगर निकाय या सार्वजनिक उपक्रम के लिए अलग कानून और मानक लागू होंगे। इसी कारण निरीक्षण टीम को निरीक्षण से पहले संबंधित संस्था के लिए 12 महत्वपूर्ण एवं संस्था-विशिष्ट प्रश्नों की प्रश्नावली तैयार करना अनिवार्य होगा।


अध्याय 5

संगठनात्मक संरचना, टीम गठन एवं नेतृत्व

“मिशन न्याय” को राष्ट्रीय, राज्य एवं जिला स्तर पर व्यवस्थित रूप से संचालित किया जाएगा। राष्ट्रीय स्तर पर प्रोजेक्ट की नीति, प्रशिक्षण, मानक, गुणवत्ता नियंत्रण, रिकॉर्ड एवं समन्वय का कार्य किया जाएगा। राज्य स्तर पर राज्य संबंधी समन्वय एवं निगरानी तथा जिला स्तर पर अधिकृत निरीक्षण टीम द्वारा मैदानी कार्य किया जाएगा।

निरीक्षण टीम

निरीक्षण के लिए पहले टीम का गठन किया जाएगा और उसके बाद अनुमति की प्रक्रिया प्रारंभ की जाएगी। विश्व मानवाधिकार अनुसंधान परिषद् के राज्य स्तरीय, राष्ट्रीय स्तरीय एवं अंतर्राष्ट्रीय स्तरीय पदाधिकारी “मिशन न्याय” के अंतर्गत केवल अपने जिले में अधिकृत निरीक्षण टीम के साथ निरीक्षण कर सकेंगे। प्रत्येक निरीक्षण टीम में न्यूनतम 3 सदस्य और अधिकतम 5 सदस्य होंगे। प्रत्येक टीम में कम से कम एक अधिवक्ता और कम से कम एक पत्रकार का होना अनिवार्य होगा। आवश्यकता के अनुसार शोधकर्ता, समाजसेवी या संबंधित विषय के विशेषज्ञ को भी टीम में शामिल किया जा सकेगा।

भूमिका निर्धारण

निरीक्षण टीम में लीगल एडवाइजर की भूमिका अत्यंत महत्वपूर्ण होगी। वे संबंधित कानूनों, नियमों, शासन की गाइडलाइन एवं न्यायालयीन निर्णयों का अध्ययन कर टीम को विधिक नेतृत्व प्रदान करेंगे। पत्रकार तथ्यात्मक मीडिया दस्तावेजीकरण एवं प्रेस संबंधी कार्य में सहयोग करेंगे। अन्य सदस्य शोध, नागरिक संवाद, प्रमाण संकलन, दस्तावेजीकरण एवं रिपोर्ट तैयार करने में सहयोग करेंगे।


अध्याय 6

प्रशिक्षण, विशेषज्ञता एवं अनुशासन

“मिशन न्याय” में निरीक्षण करने वाले प्रत्येक पदाधिकारी का प्रशिक्षित होना अनिवार्य होगा। प्रशिक्षण के लिए ऐसे सेवानिवृत्त न्यायाधीशों, उच्च न्यायालय एवं सर्वोच्च न्यायालय के अनुभवी अधिवक्ताओं तथा संबंधित विषयों के विद्वानों एवं विशेषज्ञों को नियुक्त किया जाएगा, जिन्हें जनहित याचिकाओं, राष्ट्रीय एवं अंतरराष्ट्रीय कानून, संवैधानिक कानून, मानवाधिकार, प्रशासनिक कानून और संबंधित सार्वजनिक संस्थानों के क्षेत्र में व्यापक अनुभव हो। निरीक्षण टीम में शामिल होने के लिए प्रत्येक पदाधिकारी के पास संबंधित विषय में विश्व मानवाधिकार अनुसंधान परिषद् द्वारा जारी प्रशिक्षण प्रमाण-पत्र होना अनिवार्य होगा। प्रशिक्षण में संविधान, मानवाधिकार, संबंधित अधिनियम एवं नियम, शासन की गाइडलाइन, न्यायालयीन निर्णय, जनहित याचिका की अवधारणा, निरीक्षण प्रक्रिया, 12 प्रश्नों की प्रश्नावली, प्रमाण संकलन, वीडियोग्राफी, नागरिक संवाद, रिपोर्ट लेखन, मीडिया आचार एवं Follow-up जैसे विषय शामिल होंगे। प्रशिक्षण को केवल सैद्धांतिक न रखकर अध्ययन, Case Study, Mock Inspection, Practical Exercise, Legal Research और Report Writing के माध्यम से व्यावहारिक बनाया जाएगा। प्रशिक्षकों के मार्गदर्शन और प्रशिक्षण की गुणवत्ता के लिए एक प्रशिक्षण एवं अनुशासनात्मक समिति गठित की जाएगी। यह समिति प्रशिक्षकों को मार्गदर्शन देने, प्रशिक्षण की गुणवत्ता की समीक्षा करने और आवश्यक सुधारों के संबंध में सुझाव देने का कार्य करेगी। निरीक्षण टीम में लीगल एडवाइजर को विशेष नेतृत्वकारी भूमिका दी जाएगी, क्योंकि उन्हें संबंधित कानूनों का गहन अध्ययन करने के साथ-साथ उनके वास्तविक धरातलीय क्रियान्वयन का मूल्यांकन करने में टीम का मार्गदर्शन करना होगा।


अध्याय 7

अनुमति एवं निरीक्षण की कार्यप्रणाली

टीम गठन, प्रशिक्षण और संबंधित संस्था के कानूनी अध्ययन के बाद निरीक्षण के लिए नियमानुसार अनुमति प्राप्त की जाएगी। सबसे पहले संबंधित संस्था या कार्यालय से अनुमति के लिए आवेदन किया जाएगा। यदि संबंधित कार्यालय अनुमति देने से इंकार करता है, तो बिना अनुमति के प्रतिबंधित क्षेत्र में प्रवेश नहीं किया जाएगा। ऐसी स्थिति में संस्था के अधिकारक्षेत्र के अनुसार सक्षम उच्च प्राधिकरण के समक्ष नियमानुसार अनुमति अथवा प्राधिकरण के लिए आवेदन किया जा सकेगा। अनुमति प्राप्त होने के बाद टीम निर्धारित तिथि एवं समय पर निरीक्षण करेगी। निरीक्षण का उद्देश्य संस्था के विरुद्ध कार्रवाई करना नहीं बल्कि कानून एवं निर्धारित मानकों के अनुसार सेवाओं और व्यवस्थाओं का अध्ययन करना होगा। प्रत्येक औपचारिक निरीक्षण की वीडियोग्राफी अनिवार्य होगी। निरीक्षण के दौरान संस्था के अधिकारियों एवं कर्मचारियों के साथ सम्मानजनक और पेशेवर व्यवहार रखा जाएगा।


अध्याय 8

निरीक्षण मूल्यांकन, नागरिक सहभागिता एवं प्रमाण

निरीक्षण के दौरान संस्था की सेवाओं, सुविधाओं, आधारभूत संरचना, नागरिकों की पहुँच, सुरक्षा, शिकायत निवारण, पारदर्शिता, सेवा वितरण और निर्धारित मानकों के अनुपालन का अध्ययन किया जाएगा। जहाँ उचित हो, नागरिकों से उनके अनुभव और समस्याओं के संबंध में जानकारी ली जाएगी। कर्मचारियों से भी संस्था की प्रक्रिया और उपलब्ध संसाधनों के संबंध में तथ्यात्मक जानकारी प्राप्त की जा सकती है। प्रत्येक महत्वपूर्ण Finding को उपलब्ध प्रमाण से समर्थित करने का प्रयास किया जाएगा। प्रमाण में सार्वजनिक दस्तावेज, रिकॉर्ड, फोटो, वीडियो, नागरिक feedback, उपलब्ध सरकारी सामग्री तथा अन्य वैध स्रोत शामिल हो सकते हैं। किसी व्यक्ति से दबाव डालकर जानकारी प्राप्त नहीं की जाएगी और व्यक्तिगत एवं संवेदनशील जानकारी की गोपनीयता का सम्मान किया जाएगा।

कानून बनाम वास्तविक स्थिति

निरीक्षण टीम केवल यह देखकर कि कोई सुविधा कम दिखाई दे रही है, उसे स्वतः कानूनी उल्लंघन घोषित नहीं करेगी। पहले लागू कानून या मानक निर्धारित किया जाएगा, फिर वास्तविक स्थिति का अध्ययन किया जाएगा और दोनों के बीच अंतर को प्रमाण के आधार पर दर्ज किया जाएगा।

अध्याय 9

निरीक्षण रिपोर्ट, जवाबदेही एवं सुधार प्रक्रिया

निरीक्षण के बाद एक विस्तृत रिपोर्ट तैयार की जाएगी। रिपोर्ट में संस्था का परिचय, निरीक्षण तिथि, टीम सदस्यों का विवरण, अनुमति, लागू कानून, नियमावली, शासन की गाइडलाइन, न्यायालयीन निर्णय, 12 प्रश्नों के उत्तर, निरीक्षण अवलोकन, प्रमाण, Findings, कमियाँ, संस्था की प्रतिक्रिया और सुधारात्मक अनुशंसाएँ शामिल की जाएँगी। जहाँ उचित हो, महत्वपूर्ण findings के संबंध में संबंधित संस्था से स्पष्टीकरण या तथ्यात्मक प्रतिक्रिया प्राप्त की जाएगी। इसके बाद रिपोर्ट संस्था के अधिकारक्षेत्र के अनुसार सक्षम उच्च प्राधिकरण को भेजी जाएगी। “मिशन न्याय” का उद्देश्य केवल रिपोर्ट भेजना नहीं बल्कि आवश्यकतानुसार Follow-up करना भी होगा। संबंधित प्राधिकरण से प्रतिक्रिया एवं सुधारात्मक कार्रवाई की जानकारी प्राप्त करने का प्रयास किया जाएगा।

अध्याय 10

जनजागरूकता, मीडिया एवं सार्वजनिक सहभागिता

“मिशन न्याय” का एक प्रमुख उद्देश्य नागरिकों को उनके अधिकारों के प्रति जागरूक करना होगा। निरीक्षण से जुड़े विषयों पर आवश्यकता के अनुसार जागरूकता शिविर आयोजित किए जा सकते हैं। नागरिकों को उनके अधिकारों, सार्वजनिक सेवाओं, सरकारी योजनाओं, शिकायत निवारण व्यवस्था और उपलब्ध वैधानिक उपायों की जानकारी दी जाएगी। निरीक्षण के बाद सत्यापित तथ्यों के आधार पर प्रेस विज्ञप्ति तैयार की जाएगी और उसे संबंधित समाचार पत्रों एवं अन्य उपयुक्त मीडिया संस्थानों तक भेजा जा सकेगा। मीडिया संचार में केवल सत्यापित और प्रमाण-आधारित जानकारी दी जाएगी। किसी व्यक्ति अथवा संस्था के विरुद्ध अप्रमाणित आरोप प्रकाशित नहीं किए जाएँगे। “मिशन न्याय” का उद्देश्य मीडिया का उपयोग व्यवस्था सुधार और नागरिक जागरूकता के माध्यम के रूप में करना होगा।


अध्याय 11

रिकॉर्ड, निगरानी, गुणवत्ता नियंत्रण एवं संगठनात्मक जवाबदेही

प्रत्येक निरीक्षण के बाद पूर्ण निरीक्षण रिकॉर्ड तैयार किया जाएगा। निरीक्षण टीम को FORM-A, FORM-B, FORM-C, अनुमति की प्रति, प्रेस विज्ञप्ति, प्रकाशित समाचार/समाचार पत्र की प्रति तथा संबंधित कार्यालय के अधिकारियों के साथ लिए गए फोटो संलग्न करके एक संयुक्त PDF दस्तावेज तैयार करना होगा और उसे राष्ट्रीय कार्यालय को प्रेषित करना होगा। सभी फॉर्म के प्रारूप इस विवरणिका के अंत में संलग्न किए गए हैं। यह PDF संगठन के राष्ट्रीय कार्यालय को: info@whrrc.org पर भेजना आवश्यक होगा, ताकि निरीक्षण को आधिकारिक रिकॉर्ड में शामिल किया जा सके। “मिशन न्याय” के लिए भविष्य में डिजिटल Monitoring System विकसित किया जा सकता है, जिसमें प्रत्येक निरीक्षण का पूरा रिकॉर्ड रखा जाएगा। राष्ट्रीय कार्यालय समय-समय पर निरीक्षण रिपोर्टों की गुणवत्ता की समीक्षा करेगा। यह देखा जाएगा कि निरीक्षण निर्धारित अनुमति, प्रशिक्षण, कानूनी अध्ययन, 12 प्रश्नों की प्रश्नावली, वीडियोग्राफी, प्रमाण और रिपोर्टिंग प्रक्रिया के अनुसार हुआ या नहीं। “मिशन न्याय” स्वयं भी जवाबदेही के सिद्धांत का पालन करेगा। किसी सदस्य द्वारा अनुशासनहीनता, व्यक्तिगत लाभ, दबाव, धमकी अथवा निरीक्षण अधिकारों के दुरुपयोग की शिकायत होने पर संगठन की निर्धारित प्रक्रिया के अनुसार समीक्षा की जाएगी। हितों के टकराव की स्थिति में संबंधित सदस्य को निरीक्षण से अलग किया जा सकता है। “मिशन न्याय” स्वयं को न्यायालय, पुलिस, वैधानिक जांच एजेंसी अथवा सरकारी निरीक्षण प्राधिकरण के रूप में प्रस्तुत नहीं करेगा। इसका कार्य अनुसंधान, निरीक्षण, जागरूकता, तथ्य-संकलन, रिपोर्ट, अनुशंसा और Follow-up तक केंद्रित रहेगा।


अध्याय 12

प्रभाव मूल्यांकन, व्यवस्थागत सुधार एवं अंतिम संकल्प

“मिशन न्याय” की सफलता केवल निरीक्षणों की संख्या से निर्धारित नहीं होगी। इसका वास्तविक मूल्यांकन इस आधार पर किया जाएगा कि निरीक्षण के बाद नागरिकों को बेहतर सेवाएँ मिलीं या नहीं, संस्थागत कमियों में सुधार हुआ या नहीं, सक्षम प्राधिकरण ने प्रतिक्रिया दी या नहीं और बार-बार सामने आने वाली समस्याओं के समाधान के लिए व्यवस्थागत कदम उठाए गए या नहीं। यदि अलग-अलग जिलों अथवा संस्थाओं में एक जैसी समस्या लगातार सामने आती है तो “मिशन न्याय” उस विषय पर व्यापक शोध कर व्यवस्थागत सुधार रिपोर्ट तैयार कर सकता है। राष्ट्रीय स्तर पर प्रत्येक वर्ष “मिशन न्याय” की वार्षिक रिपोर्ट तैयार की जा सकती है, जिसमें निरीक्षण, जागरूकता कार्यक्रम, प्रमुख findings, प्रशासनिक प्रतिक्रियाएँ, सुधारात्मक कार्रवाई और व्यवस्थागत समस्याओं का विश्लेषण किया जा सकेगा।

“मिशन न्याय” का मानक कार्यचक्र

“MISSION NYAY”

A National Initiative for Justice, Rights and Systemic Reform in Public Institutions

“MISSION NYAY” is a national public-interest project established by the World Human Rights Research Council (WHRRC). It was launched on 26 August 2026 by Dr. Jyoti Zongluju, Chairperson of the Council and Advocate, Supreme Court of India.


CHAPTER 1

Introduction, Background and Establishment

In India, various types of public services and facilities are provided to citizens by the Central Government, State Governments and Local Governments. Public funds are utilized for the operation of these services. The functioning of these institutions is governed by the Constitution, Acts, laws, rules, government guidelines, departmental directions, judicial decisions and prescribed service standards. In practice, there may sometimes be a gap between the system prescribed by law and the services available on the ground. Due to inadequate awareness of their rights, citizens may not be able to effectively utilize available services and legal remedies. ““MISSION NYAY”” has been established keeping this need in mind. The objective of ““MISSION NYAY”” is not to conduct campaigns against public institutions. Its objective is to study the gap between law and the actual situation, create awareness among citizens regarding their rights, document deficiencies on the basis of facts and evidence, and submit a structured report to the competent authority for improvement. This project does not view public institutions and administration as adversaries, but seeks to play a supportive role in building a system that provides better services to citizens.

CHAPTER 2

Vision, Mission, Objectives and Fundamental Principles

The broad vision of “MISSION NYAY” is to contribute to the development of a system in which citizens are aware of their rights and public institutions effectively fulfil their legal and administrative responsibilities. The mission of this project is to systematically study the services and functioning of public institutions, create awareness among citizens regarding their rights, assess compliance with laws and prescribed standards, document deficiencies with evidence, and submit reports to competent authorities along with corrective recommendations.

Key Objectives

The key objectives of “MISSION NYAY” shall include citizen rights awareness, public service assessment, study of compliance with laws and rules, examination of government guidelines, reference to judicial decisions, study of relevant international standards, collection of facts and evidence, institutional accountability, corrective recommendations and Follow-up. An important objective of this project is not only to study the problem of a particular institution, but also to identify it as a systemic problem if a similar problem is found in multiple institutions and to undertake a study for broader reform.

Fundamental Principles

“MISSION NYAY” shall be based on the principles of justice, human dignity, equality, non-discrimination, transparency, accountability, impartiality, integrity, respect for law, public interest, evidence-based methodology, confidentiality and systemic reform.


CHAPTER 3

Scope and Public Institutional Framework

The scope of “MISSION NYAY” shall be limited only to those public institutions, offices, departments and public-sector undertakings that receive public funds or budgetary allocations from the Central Government, State Government or Local Government. Depending upon the requirements and priorities of the project, these may include government hospitals, schools, colleges, universities, public health institutions, police institutions, prisons, municipal bodies, Panchayats, public distribution systems, social welfare institutions, public transport, government offices and other publicly funded institutions. An institution shall be selected taking into consideration its public importance, impact on citizens, nature of services, available information, potential systemic issues and public interest. “MISSION NYAY” shall not inspect any institution solely on the basis of personal allegations or an unverified complaint. Where a complaint indicates a broader institutional issue, an institutional inspection may be considered after a preliminary study.


CHAPTER 4

Legal and Standards-Based Preliminary Study

One of the most important features of the inspection process under “MISSION NYAY” shall be that a comprehensive legal study of the institution shall be mandatory before the inspection. Before conducting an inspection of any public institution or submitting an application for inspection permission, the Acts, laws, rules, regulations, government guidelines, government orders, departmental directions, citizen charters, service standards and other government documents applicable to the concerned institution shall be studied. In addition, important and relevant judicial decisions relating to the subject shall be studied. Where relevant, the applicable constitutional provisions and international human rights and public service standards shall also be studied. While using international standards, it shall be clearly identified which provision is legally binding under Indian law and which constitutes an international guiding principle or best practice.

Institution-Specific Study

Under “MISSION NYAY”, a separate legal study shall be conducted for each institution. The laws and standards applicable to a hospital will differ from those applicable to a school, police institution, prison, municipal body or public-sector undertaking. Therefore, before an inspection, the inspection team shall be required to prepare a questionnaire containing 12 important and institution-specific questions for the concerned institution.


CHAPTER 5

Organizational Structure, Team Formation and Leadership

“MISSION NYAY” shall be implemented systematically at the National, State and District levels. At the National level, the project's policies, training, standards, quality control, records and coordination shall be managed. At the State level, state-level coordination and monitoring shall be undertaken, while field activities shall be carried out by authorized inspection teams at the District level.

Inspection Team

For inspection, the team shall be constituted first and the permission process shall thereafter be initiated. State-level, National-level and International-level office bearers of the World Human Rights Research Council may conduct inspections under “MISSION NYAY” only within their respective district along with an authorized inspection team. Each inspection team shall consist of a minimum of 3 members and a maximum of 5 members. Every team must include at least one Advocate and at least one Journalist. Researchers, social workers or subject-matter experts may also be included in the team as required.

Role Allocation

The Legal Advisor shall have a highly important role in the inspection team. The Legal Advisor shall study the relevant laws, rules, government guidelines and judicial decisions and provide legal leadership to the team. The Journalist shall assist with factual media documentation and press-related activities. Other members shall assist with research, citizen interaction, evidence collection, documentation and preparation of reports.


CHAPTER 6

Training, Expertise and Discipline

Every official conducting inspections under “MISSION NYAY” shall be required to undergo training. For training, retired judges, experienced advocates of the High Courts and Supreme Court, and scholars and experts in relevant subjects shall be appointed, who have extensive experience in Public Interest Litigation, national and international law, constitutional law, human rights, administrative law and relevant public institutions. Every official joining an inspection team shall be required to possess a training certificate issued by the World Human Rights Research Council in the relevant subject. The training shall include the Constitution, human rights, relevant Acts and rules, government guidelines, judicial decisions, the concept of Public Interest Litigation, inspection procedures, the questionnaire of 12 questions, evidence collection, videography, citizen interaction, report writing, media ethics and Follow-up. Training shall not be limited to theoretical instruction but shall be made practical through study, Case Studies, Mock Inspections, Practical Exercises, Legal Research and Report Writing. A Training and Disciplinary Committee shall be constituted for the guidance of trainers and quality of training. This committee shall provide guidance to trainers, review the quality of training and make recommendations regarding necessary improvements. The Legal Advisor shall be given a special leadership role in the inspection team because they are required not only to have an in-depth study of the relevant laws but also to guide the team in assessing their actual implementation on the ground.


CHAPTER 7

Permission and Inspection Procedure

After team formation, training and the legal study of the concerned institution, permission for inspection shall be obtained as per the prescribed procedure. An application for permission shall first be submitted to the concerned institution or office. If the concerned office refuses to grant permission, entry into any restricted area without permission shall not be made. In such a situation, an application for permission or authorization may be submitted, as per the prescribed procedure, before the competent higher authority according to the jurisdiction of the institution. After obtaining permission, the team shall conduct the inspection on the निर्धारित date and time. The purpose of the inspection shall not be to take action against the institution but to study its services and systems in accordance with applicable laws and prescribed standards. Videography of every formal inspection shall be mandatory. During the inspection, respectful and professional conduct shall be maintained with the officers and employees of the institution.


CHAPTER 8

Inspection Assessment, Citizen Participation and Evidence

During the inspection, the services, facilities, infrastructure, accessibility for citizens, safety, grievance redressal, transparency, service delivery and compliance with prescribed standards of the institution shall be studied. Where appropriate, information may be obtained from citizens regarding their experiences and problems. Factual information regarding the procedures and available resources of the institution may also be obtained from employees. Every important Finding shall be supported, as far as possible, by available evidence. Evidence may include public documents, records, photographs, videos, citizen feedback, available government material and other lawful sources. No person shall be pressured to provide information, and the confidentiality of personal and sensitive information shall be respected.

Law versus Actual Situation

The inspection team shall not automatically declare a legal violation merely because a facility appears inadequate. The applicable law or standard shall first be identified, then the actual situation shall be studied, and the gap between the two shall be documented on the basis of evidence.

CHAPTER 9

Inspection Report, Accountability and Corrective Process

A detailed report shall be prepared after the inspection. The report shall include the profile of the institution, inspection date, details of team members, permission, applicable laws, rules, government guidelines, judicial decisions, answers to the 12 questions, inspection observations, evidence, Findings, deficiencies, response of the institution and corrective recommendations. Where appropriate, clarification or factual response may be obtained from the concerned institution regarding significant findings. Thereafter, the report shall be submitted to the competent higher authority according to the jurisdiction of the institution. The objective of “MISSION NYAY” shall not be limited to submitting the report but shall also include Follow-up wherever necessary. Efforts shall be made to obtain information regarding the response and corrective action taken by the concerned authority.

CHAPTER 10

Public Awareness, Media and Public Participation

One of the major objectives of “MISSION NYAY” shall be to create awareness among citizens regarding their rights. Awareness camps may be organized on subjects related to inspections as required. Citizens shall be informed about their rights, public services, government schemes, grievance redressal mechanisms and available legal remedies. After the inspection, a press release shall be prepared on the basis of verified facts and may be sent to relevant newspapers and other appropriate media institutions. Only verified and evidence-based information shall be provided in media communication. Unverified allegations against any person or institution shall not be published. The objective of “MISSION NYAY” shall be to use the media as a means of system improvement and citizen awareness.


CHAPTER 11

Records, Monitoring, Quality Control and Organizational Accountability

A complete inspection record shall be prepared after every inspection. The inspection team shall prepare a consolidated PDF document containing FORM-A, FORM-B, FORM-C, a copy of the permission, the press release, a copy of the published news/newspaper, and photographs taken with the officials of the concerned office and shall submit it to the National Office. The formats of all forms are attached at the end of this booklet. This PDF shall be sent to the National Office of the organization at: info@whrrc.org, so that the inspection can be included in the official records. A digital Monitoring System may be developed for “MISSION NYAY” in the future, in which complete records of every inspection may be maintained. The National Office shall periodically review the quality of inspection reports. It shall be examined whether the inspection was conducted in accordance with the prescribed permission, training, legal study, questionnaire of 12 questions, videography, evidence and reporting process. “MISSION NYAY” shall itself follow the principle of accountability. In case of a complaint of indiscipline, personal gain, pressure, intimidation or misuse of inspection powers by any member, the matter shall be reviewed according to the prescribed procedure of the organization. In case of a conflict of interest, the concerned member may be removed from the inspection. “MISSION NYAY” shall not represent itself as a court, police authority, statutory investigative agency or government inspection authority. Its work shall remain focused on research, inspection, awareness, fact collection, reporting, recommendations and Follow-up.


CHAPTER 12

Impact Assessment, Systemic Reform and Final Commitment

The success of “MISSION NYAY” shall not be determined solely by the number of inspections conducted. Its actual assessment shall be based on whether citizens received better services after the inspection, whether institutional deficiencies were improved, whether the competent authority responded, and whether systemic measures were taken to resolve recurring problems. If the same problem continuously arises in different districts or institutions, “MISSION NYAY” may conduct comprehensive research on the subject and prepare a Systemic Reform Report. At the national level, an annual report of “MISSION NYAY” may be prepared, containing an analysis of inspections, awareness programmes, major findings, administrative responses, corrective actions and systemic problems.

Final Commitment

The objective of “MISSION NYAY” is not to fight against any individual, officer, department or public institution, but to contribute to the development of a better public system in accordance with law, the Constitution, prescribed government standards and citizens' rights. This Mission believes that public institutions exist for the people and that public funds are utilized in the public interest. Therefore, citizens have the right to know the extent to which prescribed services and facilities are being provided to them and, where improvement is required, to bring the matter to the attention of the competent authority in a factual and evidence-based manner. “MISSION NYAY” shall seek to develop a systematic inspection and awareness mechanism with the participation of trained advocates, journalists, researchers, social workers and subject-matter experts that is lawful, impartial, transparent, evidence-based and reform-oriented.
